Texas Democratic Senate nominee James Talarico is facing renewed questions about his position on transgender athletes competing in women’s and girls’ sports after his campaign emphasized concerns about fairness and safety despite his previous votes against statewide restrictions.
The issue could become increasingly important in the Texas Senate race, particularly among voters concerned about preserving separate athletic opportunities for women and girls.
Talarico’s campaign says his position is straightforward: transgender athletes should not participate in girls’ sports when doing so threatens safety or competitive fairness.
But Republicans and other critics argue that his legislative record tells a more complicated story.
Talarico Campaign Addresses Girls’ Sports Debate
Talarico campaign spokesperson JT Ennis recently told OutKick that the Democratic candidate has long been concerned about protecting student athletes.
According to the campaign, Talarico opposes transgender athletes participating in girls’ sports in situations where safety or fairness could be compromised.
The campaign also emphasized Talarico’s opposition to discrimination against transgender students and argued that politicians should not use individual students as political targets.
That explanation, however, has not ended questions about where Talarico would draw the line or what policies he would support if elected to the U.S. Senate.
One particularly important question remains unanswered: Would Talarico support federal legislation establishing nationwide eligibility standards for women’s and girls’ sports?
Past Texas Votes Come Under New Scrutiny
Talarico’s record in the Texas Legislature is now receiving closer attention.
In 2021, he voted against Texas House Bill 25, a measure requiring students participating in public-school interscholastic athletics to compete according to the sex listed on their birth certificate at or near the time of birth, subject to limited exceptions.
Talarico also opposed Senate Bill 29 earlier that year, another proposal dealing with eligibility rules for school athletics.
Those votes have become a major point of criticism as Talarico now stresses the importance of fairness and safety.
Republicans argue that lawmakers who believe biological differences can affect athletic competition should support clear statewide standards rather than leaving the issue to individual schools.
Talarico has taken a different approach.
Talarico Supported Local Flexibility
During debate over the Texas legislation, Talarico supported amendments that would have given schools greater discretion when deciding whether transgender students could participate in certain athletic competitions.
One proposed amendment would have altered provisions dealing with when the sex designation on a birth certificate had to be recorded.
Other proposals would have allowed coaches, principals or school boards to approve participation in circumstances that otherwise might have been prohibited.
Supporters of that approach argue that local officials are better positioned to examine individual circumstances.
Critics counter that a patchwork of local rules could produce inconsistent standards and make it more difficult to guarantee equal competitive opportunities for female athletes.
College Sports Votes Also Draw Attention
The controversy extends beyond elementary and high school athletics.
In 2023, Talarico voted against Texas Senate Bill 15, legislation restricting biological males from competing on women’s collegiate athletic teams at covered institutions in the state.
He also backed an unsuccessful amendment that would have relied on eligibility standards established by organizations such as the NCAA and NAIA.
Those organizations have since revised their policies governing women’s competition.
The changes have further intensified the national debate over whether eligibility rules should be established by lawmakers, athletic organizations or individual schools.
For many conservative voters, the central concern is whether female athletes can continue to compete in categories specifically created for women and girls.
Talarico Says His Position Has Remained Consistent
Talarico disputes accusations that he has changed his position for political reasons.
During a September interview, he said he opposes transgender athletes competing in girls’ sports when participation creates a safety or fairness problem.
He later addressed the controversy during an appearance at the Texas Tribune Festival.
Asked whether his position had changed, Talarico insisted that it had not.
His preferred approach is to allow eligibility decisions to be made locally and evaluated according to the athlete, sport and circumstances involved.
That puts him at odds with Republicans who favor broader rules establishing eligibility according to biological sex.
The disagreement represents two fundamentally different approaches to one of the most closely watched cultural and education issues in American politics.
Federal Legislation Creates Another Test
Talarico’s campaign has also faced questions about how he would approach the issue as a U.S. senator.
OutKick asked whether he would support the Protection of Women and Girls in Sports Act.
The federal proposal would establish eligibility requirements for female athletic programs at federally funded schools and institutions.
Talarico’s campaign did not directly say whether he would vote for or against the legislation.
It also did not identify an alternative federal proposal that he would support.
That leaves voters without a definitive answer about how Talarico would vote if similar legislation reached the Senate.
His campaign also did not say whether he would vote differently today on the Texas legislation he previously opposed.
What Does “Fairness” Mean?
Another important question involves how Talarico defines fairness and safety.
The national debate over transgender participation in sports frequently centers on physical differences that can emerge during male puberty, along with questions involving strength, speed, injury risk, roster positions and athletic scholarships.
Supporters of sex-based eligibility rules argue that these biological differences are the reason separate women’s athletic categories were created in the first place.
Opponents of blanket restrictions argue that circumstances vary significantly depending on an athlete’s age, competitive level and sport.
Talarico has generally favored allowing local officials to make those judgments rather than imposing one statewide or nationwide rule.
He has acknowledged that such an approach could result in transgender athletes being barred from participation in some cases.
Earlier Talarico Comment Resurfaces
Talarico has also faced renewed criticism over remarks he made during the 2021 debate.
At the time, he argued that there were circumstances in which considerations other than “perfectly fair competition” could matter.
The comment has since been repeatedly cited by political opponents.
Talarico says the statement has been presented without sufficient context and maintains that he was discussing recreational activities involving young children, including elementary-level sports such as T-ball.
He has continued to argue that competitive high school or college athletics may warrant different considerations.
Cowboys Legend Randy White Enters the Debate
The controversy received another burst of attention after Dallas Cowboys legend Randy White endorsed Republican Ken Paxton and criticized Talarico’s record.
White questioned whether Talarico’s more recent comments were consistent with his previous legislative votes.
He suggested that voters should examine whether Talarico’s position has evolved as the political environment surrounding the issue has changed.
Talarico rejects that accusation and maintains that his underlying position remains unchanged.
Texas Voters Could Make the Issue a Major Factor
The dispute is ultimately about more than one candidate’s voting record.
It reflects a larger national disagreement over how schools and governments should balance inclusion with competitive fairness in women’s athletics.
Republicans have increasingly supported laws establishing biological-sex eligibility standards for female competition.
Talarico favors a more decentralized system that gives local schools and athletic officials greater authority to make decisions based on individual circumstances.
That distinction gives Texas voters a clear policy choice.
As the Senate campaign continues, Talarico is likely to face additional pressure to explain exactly when he believes transgender participation becomes unfair, who should make that determination and whether he would support any federal protections for women’s and girls’ athletic categories.
Until those questions receive more definitive answers, his past votes and present campaign statements are likely to remain a significant issue in the race.
